District Judge Fred Biery Needs to Learn about The constitution!!

On June 1, 2011 District Judge Fred Biery said that a San Antonio school could  not have or say a prayer in their June 4 school graduation ceremony. The  Judge stated that “These students, and all other persons scheduled to speak during the graduation ceremony, shall be instructed not to present a prayer, to wit, they shall be instructed that they may not ask audience members to “stand,” “join in prayer,” or “bow their heads,” they may not end their remarks with “amen” or “in [a deity’s name] we pray,” and they shall not otherwise deliver a message that would commonly be understood to be a prayer, nor use the word “prayer” unless it is used in the student’s expression of the student’s personal belief, as opposed to encouraging others who may not believe in the concept of prayer to join in and believe the same concept.”
“The students may in stating their own personal beliefs speak through conduct such as kneeling to face Mecca, the wearing of a yarmulke or hijab or making the sign of the cross.”
“The District, through its officials, shall review, and make any necessary changes to, the students’ revised remarks to ensure that those remarks comply with this Order, and shall instruct the students that they must not deviate from the approved remarks in making their presentations.”

I wonder just what constitution this judge has studied to come up with this ridiculous ruling. Angela Hildendrand stated that she is " disappointed that my liberties are being infringed upon by this courts ruling to censor my free speech."  Thankfully Texas has a Attorney General who has actually read and understands the constitution. Attorney General Greg Abbott had the backbone to stand up and defend the constitution and free speech. All Texans should be proud that this man had the guts to uphold the constitution and our founding fathers ideas of freedom and liberty.

Our founding fathers made it perfectly clear that the Supreme court as well as congress were excluded from jurisdiction over religion. Adams once stated " There is not a shadow of right in the general government to intermeddle with religion. Its least interference with it would be a most flagrant usurpation."

In Thomas Jefferson's second inaugural address he stated............

In matters of religion, I have considered that its free exercise is placed by the constitution independent of the powers of the general government. I have therefore undertaken no occasion to prescribe the religious exercises to it; but have left them, as the constitution found them, under the direction and discipline of the state or church authorities acknowledged by the several religious societies.  


Jefferson once showed his deep satisfaction in the way churches were using the local courthouse near Jefferson's home.......


In Charlottesville, there is a good degree of religion, with a small spice only of fanaticism. We have four sects, but without either church or meeting house. The courthouse is the common temple, One Sunday in the month to each. Here Episcopalian and Presbyterian, Methodist and Baptist, meet together, join in hymning their Maker, listen with attention and devotion to each others' preachers, and all mix in society with perfect harmony. 


So you see, there is a wall of separation of church and state. That separation is there to keep the filthy ignorant federal courts and congress out of the religious practices of the people. We must return to the constitution and its rules to get the government back under the peoples control. This is not a nation of rulers law. It is a nation of peoples law. As long as the government run indoctrination centers (high schools)   continue to rob our nation of its heritage, history and our founding fathers ideas of liberty. We as a nation shall surely lose that liberty. We must educate ourselves and our children if we are to remain a free nation ruled by law, not by men. The constitution was written to keep the government under control, not the people. It will only work if we keep the people educated in the constitution. Our founders said that one of the most fundamental principles of good government is...  A constitution should be structured to permanently protect the people from the human frailties of their rulers.

This is about as clear and easy to understand as it can be - read it!! The article below is completely neutral, not anti republican or democrat. Charlie Reese, a retired reporter for the Orlando Sentinal has hit the nail directly on the head, defining clearly who it is that in the final analysis must assume responsibility for the judgments made that impact each one of us every day. Politicians are the only people in the world who create problems and then campaign against them..
Have you ever wondered, if both the Democrats and the Republicans are against deficits, WHY do we have deficits ?
Have you ever wondered, if all the politicians are against inflation and high taxes, WHY do we have inflation and high taxes ?
You and I don't propose a federal budget. The President does.
You and I don't have the Constitutional authority to vote on appropriations. The House of Representatives does.
You and I don't write the tax code, Congress does.
You and I don't set fiscal policy, Congress does.
You and I don't control monetary policy, the Federal Reserve Bank does.
One hundred senators, 435 congressmen, one President, and nine Supreme Court justices equates to 545 human beings out of the 300 million are directly, legally, morally, and individually responsible for the domestic problems that plague this country.
I excluded the members of the Federal Reserve Board because that problem was created by the Congress. In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank.
I excluded all the special interests and lobbyists for a sound reason. They have no legal authority. They have no ability to coerce a senator, a congressman, or a President to do one cotton-picking thing. I don't care if they offer a politician $1 million dollars in cash. The politician has the power to accept or reject it. No matter what the lobbyist promises, it is the legislator's responsibility to determine how he votes.
Those 545 human beings spend much of their energy convincing you that what they did is not their fault. They cooperate in this common con regardless of party.
What separates a politician from a normal human being is an excessive amount of gall. No normal human being would have the gall of a Speaker, who stood up and criticized the President for creating deficits..... The President can only propose a budget. He cannot force the Congress to accept it.
The Constitution, which is the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes. Who is the speaker of the House? Nancy Pelosi. She is the leader of the majority party. She and fellow House members, not the President, can approve any budget they want. If the President vetoes it, they can pass it over his veto if they agree to.
It seems inconceivable to me that a nation of 300 million cannot replace 545 people who stand convicted -- by present facts -- of incompetence and irresponsibility. I can't think of a single domestic problem that is not traceable directly to those 545 people. When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist.
If the tax code is unfair, it's because they want it unfair.
If the budget is in the red, it's because they want it in the red ..
If the Army & Marines are in Iraq and Afghanistan it's because they want them in Iraq and Afghanistan...
If they do not receive social security but are on an elite retirement plan not available to the people, it's because they want it that way.
There are no insoluble government problems.
Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power. Above all, do not let them con you into the belief that there exists disembodied mystical forces like "the economy," "inflation," or "politics" that prevent them from doing what they take an oath to do.
Those 545 people, and they alone, are responsible.
They, and they alone, have the power..
They, and they alone, should be held accountable by the people who are their bosses.
Provided the voters have the gumption to manage their own employees...
We should vote all of them out of office and clean up their mess!

ATF wants to ban your shotguns

Imagine that. The constitution once again under attack by our government. Wake up America!

I see that our Marxist n Chief wants to violate the 2nd amendment constitutional rights by using the ATF.  Now anyone who has read the constitution and what our founders have said about it know full well what it means. Now these Marxists are trying to ban certain guns under the pretense that they serve no sporting use. Anyone with an IQ equal too or greater than their shoe size know that guns for "sport" were not the reason for the second amendment.





The simple facts

  • The second amendment guarantees the right of the people to keep and bear arms without interference by the federal government. The founders believed it was an unalienable right to protect your life, liberty, and property.  
  • The founding fathers knew from history that when a government wanted to take away the peoples liberty and property they always tried to disarm them first.  
  • Under Title 10, section 31 of the US. Code, the militia of each state includes, "all able-bodied males at least 17 years of age and under 45 years of age who are or have (made) a declaration of intent to become citizens."
  • S Adams:  "The said constitution shall never be construed to authorize congress to ... prevent the people of the United States who are peaceable citizens from keeping their own arms." 
  • Henry: " The great object is that every man be armed...  Everyone who is able may have a gun."
If you just remember one thing let it be this. This administration has done more damage to our constitution and our rights in just a little over 2 years than the last 25 combined. What do you think will happen if we don't remove this despotic regime in 2012? We desperately need someone with uncompromising integrity to take over for this, the worst administration of the century.

More government unconstitutional intrusion

Here we go again, more big brother nanny state rules and regulations being forced on the people. I’m reading in the Arizona Republic todayhttp://www.azcentral.com/news/articles/2011/04/17/20110417federal-menu-labeling-standard-restaurants-obesity.html#ixzz1JqLqClHv
 about this unconstitutional new law that states chain restaurants will be forced to disclose the fat, sodium, and calories for all their meals. First of all this is not the federal governments job to be doing. Maybe the states can do something like this but certainly not the federal government.

Then I read the really unconstitutional thing. The FDA is going to be writing the requirements. Now I’m looking at article 1 section 1 paragraph 1 of the constitution and I don’t see anywhere in there that the FDA has any authority at all to be making law. It basically states that ALL lawmaking power is in the CONGRESS.  The FDA is once again violating our most basic rights of representation. We don’t get to vote for the FDA so they are completely unaccountable to us.

Then as I read further I find out that this was snuck in through the unconstitutional health care bill. Nothing about this is legal. These government mental midgets can’t even make it past the very first article of the constitution before they violate it. I just hope the people of Iowa confront their Sen. Tom Harkin for hiding this in the 3,000 page healthcare bill and hold him accountable for hiding an unconstitutional law within a unconstitutional law. He truly is not fit to serve in the senate. He violated his oath to uphold the constitution twice in one bill. I wonder how many other times he’s done something like this.

Congressman that are not lazy spineless jellyfish could stop this with using article 1 section 9 paragraph 7. Just don't appropriate the money for the FDA to write the rules and regulations or enforce them. Starve the FDA to death. Force them to stop regulating businesses out of business.
